3. Use of the Services is not for emergencies. If you think you have a medical or mental health emergency, or if at any time you are concerned about your care or treatment, please go to the nearest hospital or health care provider.

8. DISCLAIMERS.

1. The advice or information provided by Life Coaches via the Website is provided for life coaching purposes only and cannot be considered a substitute for examination by a doctor or other mental health professional. You are advised strongly against relying solely on, or make decisions based solely on advice provided by any Life Coach.
2. You understand and agree that although a Life Coach may be a life coach professional. KYIZOMCOACH.COM disclaims any and all liability for any life coaching services rendered by a Life Coach to you through the Website or App. You further acknowledge and agree that you take full responsibility for the decision to access a Life Coach through the Website or App and to continue to interact with such individual(s), and that the role of KYIZOMCOACH.COM is strictly limited to providing access to such Life Coaches to you.
3. Use of the Services is not for emergencies. If you think you have a medical or mental health emergency, or if at any time you are concerned about your care or treatment, please go to the nearest hospital or health care provider.
4. The Website is not a suicide helpline platform. If you are considering or contemplating suicide or feel that you are a danger to yourself or to others, you may discontinue use of the services immediately at your discretion and please notify appropriate police or emergency medical personnel.

9. INDEMNIFICATION.

YOU SHALL PROVIDE US WITH SUCH ASSISTANCE, WITHOUT CHARGE, AS WE MAY REQUEST IN CONNECTION WITH ANY SUCH DEFENSE, INCLUDING, WITHOUT LIMITATION, PROVIDING US WITH SUCH INFORMATION, DOCUMENTS, RECORDS AND REASONABLE ACCESS TO YOU, AS WE DEEM NECESSARY. YOU SHALL NOT SETTLE ANY THIRD PARTY CLAIM OR WAIVE ANY DEFENSE WITHOUT OUR PRIOR WRITTEN CONSENT.

IN THE EVENT OF A DISPUTE REGARDING ANY TRANSACTION CONDUCTED VIA THE WEBSITE OR APP, YOU HEREBY RELIEVE KYIZOMCOACH.COM, ITS AFFILIATES, THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUB-CONTRACTORS AND AGENTS FROM ALL MANNER OF ACTIONS, CLAIMS OR DEMANDS AND FROM ANY AND ALL LOSSES (DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL), DAMAGES, COSTS OR EXPENSES, INCLUDING, WITHOUT LIMITATION, COURT COSTS AND ATTORNEYS’ FEES, WHICH MEMBER MAY HAVE AGAINST ONE OR MORE OF THE ABOVE.

10. LIMITATION OF LIABILITY.

Since a substantial part of our KYIZOMCOACH.COM Website is available to all, it is a condition that your use of our website is at your own risk. We shall not be liable to you or in breach of this User Agreement for any delay or failure to perform any obligation if the delay or failure is due to a cause beyond our reasonable control including, without limitation, the blocking or restricting of information to and/or from our network.

Force Majeure: You understand and acknowledge that the Platform may be subject to limitations, delays and other problems inherent in the use of third-party communication networks and facilities that are outside of KYIZOMCOACH.COM’ control, and thus KYIZOMCOACH.COM will not be responsible for any delays, failures, or damages associated with the Platform which result from any system delays, downtimes, interruptions or other failures of or problems with the Platform which are outside of KYIZOMCOACH.COM’ control. Any Service availed by “You” through the KYIZOMCOACH.COM Platform is subject to this Privacy Policy and our Terms and Conditions. It shall be noted that such Audio/Video communication may be shared with the Users, Clients or the Life Coaches on their request by KYIZOMCOACH.COM.
• Information we collect automatically. When you interact with the Services, we may automatically collect information such as traffic data, logs, referring/exit pages, web page requests, location data, frequency and/or date and time of your activities on the Services, error information, clickstream data, IP address, usage data, and information about your Internet connection, device (such as a mobile device ID), connection speed, operating system, and/or browser. We may also collect information about your online activities over time and across third-party websites or other online services. For any content that you share on our Website’s discussion forum or through other communications with us, that contain Intellectual Property Rights, like photos and videos (“IP Content”), you specifically grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license (“IP License”) to use such User Content for the purpose of providing the Services to you. This IP License will end when you delete such IP Content or your User Account. This Clause does not apply to images, videos or other content containing Intellectual Property Rights, shared only with your Expert while availing the Services.

When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be made available to others).

6. HOW DO WE COLLECT, PROTECT AND SHARE INFORMATION YOU PROVIDE DURING PERSONAL COACHING?

1. Any information shared by you during personal coaching (“Confidential Information”) shall be excluded from the definition of Personal Information and shall not be collected/used in the same manner as Personal Information as mentioned in above clauses.
2. Your Confidential Information shall not be disclosed or shared by KYIZOMCOACH.COM, its employees, its agents or any third party contractors, including Experts with any third party, either orally or in writing, except in the following circumstances:
   1. If KYIZOMCOACH.COM believes that there is a significant/ real/ imminent threat or risk to your health, safety or life or to the health, safety or life of any other person or the public (“Red Flags”);
   2. If KYIZOMCOACH.COM is required to share such Confidential Information to any authority by law; and
   3. If you have claimed a health care insurance and such Confidential Information is required by the insurer.
3. In case of Red Flags, KYIZOMCOACH.COM may share your Confidential Information and Personal Information with your employer, institution or other entity enabling you to access our Services.

1. The Website may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of KYIZOMCOACH.COM.
